This paper examines the main aspects of Investor-State dispute settlement from the perspective of both the investor and the host state. Investors and capital-exporting countries favor these disputes being resolved in accordance with international third party dispute settlement procedures. In contrast, capital-importing countries traditionally maintain that the disputes be resolved in the national courts of the host country. This paper reveals the different avenues available for resolving these disputes, highlighting the main approaches that are available to host states and investors in the prevailing economic environment.
